Probably is "gently used". Everyone I have seen who has bought one of those exact kind of cases new has it looking like that within a surprisingly short amount of time after purchase.

Mine looks exactly like that, if not worse. Perfect for day tripping through Pioneer Square. I’ll probably have to pay $5-$15 to have it responsibly reycycled in Kitsap.....
